    У статті здійснено комплексний аналіз елементів складу злочину, передбаченого статтею 438 КК України, зокрема: безпосередніх об’єктів, предметів і потерпілих. Досліджено колізії між поняттями «національні цінності» у національному законодавстві та «культурні цінності» у міжнародному гуманітарному праві, а також запропоновано підходи до їх розмежування і криміналізації посягань на спеціальні об’єкти. Окрему увагу приділено класифікації збройних конфліктів (міжнародних та неміжнародних) і залежності переліку потерпілих від типу конфлікту. Зроблено висновок, що об’єктами захисту можуть бути не лише особи, а й цінності цивільного призначення. У статті підкреслено потребу вдосконалення кримінального законодавства шляхом конкретизації категорій потерпілих та предметів злочину.The article provides a comprehensive analysis of the components of the crime under Article 438 of the Criminal Code of Ukraine, particularly focusing on its immediate objects, the items involved, and the victims. It addresses discrepancies between the terms “national values” in Ukrainian law and “cultural property” in international humanitarian law, proposing approaches to their differentiation and separate criminalization.Special attention is given to the classification of armed conflicts (international and non-international) and how the list of victims depends on the type of conflict. The authors conclude that not only persons but also civilian items of value are protected objects. The article emphasizes the need to improve criminal legislation by specifying the categories of victims and objects of crimes.
