Він дозволяє обмежувати конституційні права і свободи на певний час за наявності зовнішньої загрози. Це тому, що воєнний стан надає владі необхідні повноваження для захисту національної безпеки від агресії. У Конституції України зазначено, що права людини підлягають виключному захисту в силу їх високої соціальної цінності. Тому що Конституція визнає життя, здоров'я, честь, гідність, безпеку і свободу людини недоторканними. Всі ці причини зумовлені складністю сучасної дійсності.
